However, any services supplied under a consumer agreement carry the warranties provided under Ontario's Consumer Protection Act, 2002 and the Sale of Goods Act, and we warrant that services are of reasonably acceptable quality as required by Ontario law.

We do not warrant that:

The Site will be uninterrupted, timely, secure, or error-free
The information provided on the Site is accurate, complete, or current at all times
Any defects or errors will be corrected immediately
The Site is free from viruses or other harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE ONTARIO AND CANADIAN LAW, IN NO EVENT SHALL CANADA WATERPROOFERS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SITE.

This limitation of liability is subject to the mandatory provisions of Ontario's Consumer Protection Act, 2002, which cannot be waived or limited by contract.

Indemnification

You agree to indemnify, defend, and hold harmless Canada Waterproofers Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site, your violation of these Terms, or your violation of any rights of another party.

Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the Site shall be resolved in the courts located in Ontario, Canada, and you consent to the exclusive jurisdiction of such courts. Dispute Resolution

Before initiating any legal action, we encourage parties to attempt to resolve disputes through negotiation or mediation. If resolution cannot be achieved, disputes will be subject to the jurisdiction of Ontario courts as specified above.

Language

These Terms of Use have been prepared in English. If a French translation is provided, the English version shall prevail in the event of any inconsistency or conflict.
